EFTTEX takes seriously any member trade mark infringement and are always pleased to be able to offer our exhibitors (and visitors with questions) advice from two IP attorneys, Tania Clark LLB, LLM, Barrister, RTMA, FCITMAPartner, President of CITMA and Russell Edson, Senior Associate and Patent attorney at Withers & Rogers LLP.  They will be running the following:



The presentation will cover the three main intellectual property rights, relevant to the sector, including a discussion of how to obtain them, how they can be enforced and some practical examples from established case law.

The presentation will include the following sections:


  1. Trade Marks

- TM and Brand dichotomy

- The importance of monitoring your mark, clearing the proposed mark and avoiding infringement

- Requirements for a mark to be registered including classification of goods and further requirement for shape marks and unconventional marks.

- Opposition proceedings

  1. Patents

- Requirements for patentability i.e. novelty, inventive step, detecting infringement

  1. Designs

- Requirements: Novelty and individual character

- Differences between EU unregistered and registered rights

- Practical examples from case law

Meet the Speakers

Tania Clark LLB, LLM, Barrister, RTMA, FCITMAPartner, President of CITMA.

Tania is a trade mark attorney at Withers & Rogers. Tania has handled multinational trade mark and design applications and is a keen advocate of the Madrid Protocol and Hague systems. Tania has worked with clients in most sectors but her present portfolio includes companies across a wide range, including finance, internet gambling, prepared foods, electronics, prostheses and jewellery.

Tania has strong communication skills and is adept at negotiating settlements of conflicts. She has had considerable experience in managing worldwide filing programmes.

Tania is a Fellow and President of CITMA (Chartered Institute of Trade Mark Attorneys).

Tania has a law degree from Birmingham University and a Master’s degree in Law from London University (LSE). She also has a Diploma in French Law from Limoges University in France.

Tania is recognised in the World Trade Mark Review 1000 for 2018 for her knowledge of “international brand protection” along with “her talent for putting disputes to bed

Russell Edson is a patent attorney in the Advanced Engineering group. 

Russell has experience in mechanical technology areas including oil exploration and extraction, medical instruments, automotive, aerospace, packaging and manufacturing technology, as well as computer implemented control systems and graphical user interfaces. Russell advises clients on patent protection for functional aspects of fishing equipment and on design protection for aesthetic aspects of products in the sector.

Russell studied Manufacturing Engineering and Management with French at the University of Bath, including a year in France completing a research project at the Ecole Nationale Supérieure d’Electricité et de Mécanique (ENSEM) in Nancy.
